This litigation is rooted in the defense of our First Amendment rights, challenging FDA restrictions on commercial speech that stifle open discourse and limit the free exchange of information.
Why This Matters
The First Amendment guarantees our right to speak freely and access information without undue restrictions. Yet the FDA forbids us from speaking the plain truth to the American public — that nicotine vaping is vastly safer than cigarettes and is highly effective in helping to quit smoking. The agency itself, along with many leading scientific authorities, acknowledge these well-established facts. Yet if we use those same words with our customers, the FDA threatens us with prosecution, fines, and worse.
We are not going to stand for it and this lawsuit aims to hold the FDA accountable and ensure that our rights to free speech and access to information are restored.
